Rental service-charge reconciliation in France: calculation and evidence

Annual service-charge reconciliation compares recoverable expenditure attributable to the tenant with advances already paid for the same period. It can produce an additional payment or a refund. It does not let the landlord pass every ownership expense to the tenant.

This guide covers French private main-residence tenancies using service-charge advances. It explains how to prepare a statement; the tenancy regime and each expense still need checking. It is not guidance on service charges under English leasehold law.

1. Check whether payments are advances or a fixed package

Payment methodPrincipleReconciled against actual expenditure
Advances, or provisionsPayments on account of recoverable chargesYes, annually
A fixed package permitted by the tenancy regimeContractual amountNo later balancing payment or reconciliation

A fixed package can be used in furnished tenancies or shared housing where the law permits; a French mobility lease requires one. Higher actual expenditure does not allow it to be reclassified retrospectively as advances. Any permitted revision of the package is a separate matter.

Read the lease clauses guide for this distinction. Rules on recovery, evidence and reconciliation appear particularly in Articles 23, 25-10 and 25-18 of the French Law of 6 July 1989 (opens in a new tab).

2. Start with recoverable expenses, not building-manager payment calls

Gather building accounts, invoices, contracts and relevant meter readings. Separate recoverable items from expenditure that remains the owner's responsibility. Management fees, major works or landlord insurance do not become recoverable merely because they appear in the building accounts.

Calls for funds from the copropriété manager are not, by themselves, the tenant's final charge statement. The regulatory list is set by the Decree of 26 August 1987 on recoverable charges (opens in a new tab). Some expenditure, such as building staff costs, requires a specific allocation.

Before calculating, check each item against the guide to recoverable tenant expenses.

3. Define the period and allocation method

Identify the accounting year, property and period attributable to the tenant. In a collective building, explain how each charge is shared: ownership allocation shares, individual consumption or another applicable basis for that item.

Where a tenant arrives or leaves during the accounting year, do not divide every expense by the same number of months. Use relevant readings for individually metered consumption; apply the appropriate allocation and duration to other items without passing vacancy costs to the tenant. Keep move-in and move-out readings.

4. Example: additional charges payable

Over a full year, the tenant paid €80 a month, giving €960 in advances. Verified recoverable expenditure attributable to that tenant is:

ItemAttributable annual amount
Water€250
Common-area cleaning and electricity€360
Recoverable share of collective heating€500
Total recoverable expenditure€1,110
Advances paid− €960
Additional payment€150

This is a teaching example. Not every building has these expenses, and their presence does not make them fully recoverable without verification. The balance is attributable recoverable expenditure − advances paid.

5. Refund example and statement outline

If attributable expenditure instead totals €870 against €960 paid in advances, the landlord must return €90. Reconciliation operates in both directions.

A clear statement identifies the property, period, each expense category, amount retained, allocation basis, tenant's share, advances paid and resulting balance. State the refund arrangements or requested payment date and explain how supporting records can be inspected.

6. Give advance information and access to supporting records

Send the itemised statement one month before reconciliation, including the collective building's allocation method and, where applicable, information about collective heating and hot water. Supporting documents must be available under normal conditions for six months from the statement's dispatch. Supply the property's summary by post or electronically if the tenant requests it.

Plan this timetable: an unexplained demand for immediate payment is not a sound process. Source: official French service-charge guidance (opens in a new tab).

The six-month inspection period does not mean invoices should then be destroyed. The rental document retention guide distinguishes access, archiving and limitation periods.

7. What if reconciliation is late?

Claims arising from the tenancy generally have a three-year limitation period, with the start depending on when the facts enabling action were or should have been known. This is not permission to postpone annual reconciliation deliberately.

Where reconciliation has not taken place by the end of the calendar year following the year charges became due, the tenant can request payment in twelve monthly instalments. For example, charges due in 2024 reconciled after 31 December 2025 can trigger that right. An abrupt or unfair late demand may also be disputed depending on the circumstances; seek advice on older files.

8. Adjust future advances and handle departure separately

After reconciliation, future advances must be justified by previous results and the applicable forecast budget. They do not automatically follow annual IRL rent revision.

A tenant's departure does not cancel outstanding reconciliation. In a copropriété, temporarily retaining part of the deposit has its own conditions and limits: read the security deposit guide. Do not automatically hold the entire deposit while waiting for the accounts.

Frequently asked questions

Can the full building-manager total be passed on unchanged?

No. Identify recoverable expenses and apply the appropriate property and period allocation.

Can a fixed charge package generate a balancing payment?

Not through reconciliation with actual expenditure. First check that the tenancy regime permits the package used in the contract.

How should a disagreement be handled?

Identify the disputed item, explain the calculation and provide access to evidence. Correct an error with a traceable revised statement. An ADIL housing advice service can guide the parties if disagreement continues.
