Terms of Sale

These Terms of Sale define the contractual rules applicable to the purchase and use of paid services provided by Homellya.

1. Definitions

“Service”: the Homellya platform and its features. “Subscription”: paid access to the service. “Client”: any individual or legal entity purchasing a Homellya subscription. “User”: person with access created by the Client.

2. Purpose

These Terms of Sale define the subscription, billing and usage conditions for Homellya's paid services.

3. Subscription to services

The Client may subscribe to a plan through the Homellya website. Subscribing implies full acceptance of the Terms of Sale and Terms of Use. Access to the service begins upon payment confirmation.

4. Pricing

Subscription prices are shown in euros including VAT where applicable and may be updated at any time. Any price change will be communicated to the Client at least 30 days in advance.

5. Payment

Payment for subscriptions is made by credit card or any other payment method made available through a secure payment service provider. In this context, payments are processed by Stripe, acting as an independent technical payment processor. Homellya does not store any of the Client’s banking or card data. The Client represents and warrants that they are duly authorized to use the selected payment method. In the event of a payment failure or incident, Homellya reserves the right to suspend access to the Service until full payment is received.

6. Invoicing

An invoice is issued for each payment or subscription renewal. Invoices are made available to the Client in electronic format and are accessible from the Client’s account area. Invoices may be generated, issued and stored through Stripe. The Client acknowledges and accepts that invoices are stored in a dematerialized (electronic) form. It is the Client’s responsibility to download and retain their invoices for the applicable statutory retention period. No paper invoices are sent by post.

7. Automatic renewal

Subscriptions are automatically renewed for identical periods unless terminated before the renewal date.

8. Right of withdrawal

In accordance with the provisions of the Consumer Code, the consumer Client has a period of fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without having to provide any reason. To exercise the right of withdrawal, the consumer Client must notify Homellya of their decision by means of an unambiguous statement, for example by email sent to: [contact email address]. The consumer Client may use the model withdrawal form included in these Terms of Sale, but this is not mandatory. Immediate access to the service The Homellya service is accessible immediately after registration and, where applicable, after validation of a paid plan subscription. By confirming their registration or subscription, the consumer Client expressly requests immediate access to the Homellya service before the end of the statutory fourteen (14) day withdrawal period. When the consumer Client subscribes to a paid plan and exercises their right of withdrawal after performance of the service has begun, they remain liable for an amount corresponding to the service provided up to the communication of their decision to withdraw. This amount is calculated proportionally to the total subscription price and to the period of use of the service before withdrawal. Homellya refunds the consumer Client the sums paid, after deduction of the amount corresponding to the service already provided, within fourteen (14) days from receipt of the withdrawal request. For free plans, exercising the right of withdrawal does not give rise to any refund, as no amount has been paid by the consumer Client. Exercising the right of withdrawal results in deactivation of the relevant subscription. Homellya may make the service inaccessible to the consumer Client from the time their withdrawal request is processed. 9. Subscription termination

The Client may terminate their Homellya subscription at any time from their personal area, in the section dedicated to subscription management. Termination takes effect at the end of the current subscription period. The Client retains access to the features of their plan until that date, unless the account is deleted earlier at their request or in the event of a breach of these Terms of Sale. Termination prevents automatic renewal of the subscription for the following period. No further billing will be made after termination takes effect. Except where a valid right of withdrawal is exercised within the applicable statutory period, the current subscription period remains payable and does not give rise to a prorated refund.

10. Liability

Homellya cannot be held liable for indirect damages, data loss or economic harm. The Client is responsible for the content inserted into the platform. Homellya guarantees a security level in line with industry standards.

11. Personal data

Personal data processing is described in the Privacy Policy. Homellya processes Client data in compliance with the GDPR.

12. Consumer mediation

In accordance with French consumer law, consumer Clients may use a consumer mediator free of charge to resolve disputes amicably. The contact details of the competent consumer mediator will be provided once Homellya has finalized enrollment with a CECMC-listed mediation scheme suited to digital services / SaaS activities. 13. Applicable law

These Terms of Sale are governed by French law. Any dispute shall be submitted to the competent courts.

14. Updates

Homellya may update these Terms for legal or operational reasons. The Client will be informed of any significant change.
