Guarantors, security deposits and Visale in France: key differences

In everyday French, caution sometimes means the security deposit. Legally, distinguish money paid by the tenant from a person's or organisation's commitment to cover certain debts. Visale belongs to the second category: it does not advance the deposit.
This guide compares these protections for French private main-residence tenancies. It does not promise that a guarantee covers every risk or that every protection can be combined.
1. Compare the three mechanisms
| Mechanism | Who pays or undertakes liability? | Purpose | What to check |
|---|---|---|---|
| Security deposit | Tenant pays money to the landlord | Security for tenancy obligations, with accounting and return rules | Statutory limits according to tenancy; not the final rent payment |
| Joint and several personal guarantee | A person signs a guarantee undertaking | Pay covered debts when the tenant does not | Scope, amount, duration and formal requirements |
| Visale | Action Logement grants a guarantee after validation | Cover risks specified by the scheme and contract | Eligibility, visa, guarantee validation and reporting |
The official tenant guarantor guide (opens in a new tab) distinguishes the guarantor from the money called the security deposit.
To clarify each flatmate’s obligations and when they end, read Joint liability in French shared housing: scope and end dates.
2. The deposit: capped money with return obligations
For ordinary tenancies covered by the law, the deposit is capped at one month's rent excluding charges for an unfurnished home and two months for furnished housing. A mobility lease prohibits a deposit. Particular situations, including rent paid more than two months in advance, need additional checking.
A deposit is not final rental income when received. Track its future return and any justified deductions. Our deposit amount and return guide explains the mechanism; the deductions and evidence guide covers final accounting.
For example, receiving a €900 deposit does not make it an extra month's rent available without anticipating repayment. Nor should a tenant decide it automatically replaces the final rent payment.
3. A personal guarantee: read the undertaking, not just its title
The guarantor signs a separate undertaking subject to formal requirements. Check the covered tenant, debts, limits and duration. The word solidaire, meaning joint and several, does not itself create unlimited liability.
Under the undertaking and applicable law, this form of guarantee lets the landlord pursue covered debt from the guarantor without first exhausting recovery against the tenant. It does not remove required notices or procedural steps. A simple guarantee and a joint and several guarantee therefore differ.
When a housemate changes or the contract is materially amended, do not assume an existing guarantor covers the new situation. Read our lease amendment guide and ANIL's explanation of rental guarantees (opens in a new tab).
4. Visale: a visa is not an activated guarantee contract
The applicant requests a visa confirming eligibility within its stated limits. The landlord then checks the information and validates the guarantee contract before signing the lease. Receiving the visa as an attachment does not, alone, establish that the tenancy is covered.
Check the beneficiary, validity, covered rent and consistency with the property and lease. Consult Visale's official signature and effective-date conditions (opens in a new tab) and the official application process (opens in a new tab).
Visale is free for tenants and landlords, but limits, coverage periods, exclusions and procedures must be checked in the applicable terms. Payment under the guarantee does not necessarily erase the tenant's debt: repayment to Action Logement may be required.
5. Check permitted combinations before signing
Article 22-1 of the French Law of 6 July 1989 (opens in a new tab) restricts combining a personal guarantee with insurance or other cover for tenancy obligations, with a statutory exception for certain student or apprentice tenants. Corporate landlords also face specific rules.
This does not remove the need to read each scheme's own terms. Visale prohibits another guarantee covering the same risks during the same period: do not automatically add a personal guarantor or insurance for those risks. See the official Visale combination rule (opens in a new tab).
A legally permitted deposit can accompany Visale; Visale does not fund it. Mobility leases remain an important exception because deposits are prohibited. Source: Visale and the security deposit (opens in a new tab).
6. Keep each protection's documents separately
Retain the lease, guarantee undertaking or Visale contract, relevant evidence, validity dates and proof of required steps. Our rental application guide explains why applicant and guarantor document lists are not interchangeable.
If a payment is missed, promptly check the guarantee's reporting deadlines and required evidence. Amicable discussions should not obscure these duties. Our late rent guide separates arrears tracking from ongoing rent.
Frequently asked questions
Does Visale pay the deposit?
No. Distinguish a guarantee from deposit funding. A visa does not mean the deposit has been paid.
Does a guarantor cover every item of damage without limit?
No. Coverage depends on the undertaking and applicable rules. Establish the debt and check the scope instead of promising automatic payment.
Should evidence be kept after departure?
Retain it according to administration needs, applicable deadlines and any dispute. Our document retention guide helps organise this without keeping everything indefinitely.
